By accessing the website, creating an account, connecting a broker, enabling paper or live trading workflows, or purchasing a subscription, you agree to these Terms of Use. If you do not agree, you must not use XeanVI.
XeanVI provides software tools for market scanning, AI-assisted analysis, playbook and rule management, execution workflow tools, automation controls, and trade journaling. XeanVI is software only and does not custody customer cash or securities. When authorized by you, orders are transmitted through supported third-party broker infrastructure.
XeanVI is not a broker-dealer, investment adviser, financial adviser, financial planner, exchange, bank, custodian, or tax/legal advisor. AI outputs, scanners, catalysts, scores, alerts, signals, and dashboard content are informational software outputs only and are not recommendations to buy, sell, hold, short, or trade any security. You are solely responsible for evaluating all trades and risks.
Trading stocks, ETFs, leveraged and inverse products, penny stocks, volatile securities, and day trading strategies involves substantial risk. You may lose some or all capital. Slippage, spreads, halts, outages, liquidity constraints, latency, API failures, and configuration errors may increase losses. Past performance, examples, screenshots, backtests, paper trading, and simulated results do not guarantee future or live trading results.
XeanVI executes based on your selected playbook settings, risk controls, broker permissions, and account configuration. Users are solely responsible for their trading decisions, broker account, risk settings, and resulting gains or losses. Automated trading can amplify losses when settings are incorrect or market/API conditions change. You must monitor activity, verify settings before live use, and disable automation when needed. XeanVI may pause, throttle, or restrict automation during malfunction, abuse, maintenance, extreme volatility, or compliance and security concerns.
Any supported broker is an independent third party. Its own account agreements, disclosures, margin/PDT rules, fees, data terms, API terms, privacy policies, and regulatory obligations govern your brokerage account. XeanVI is not your broker unless expressly stated, and does not control broker approvals, restrictions, executions, rejected orders, fills, margin calls, data feeds, downtime, or regulatory limits. You authorize XeanVI to transmit instructions only within your connected permissions and settings. You remain responsible for revoking broker permissions when desired.
Paid plans are billed through Stripe or another authorized payment processor. Stripe processes payments; XeanVI does not store full payment card numbers. Subscriptions renew automatically until cancelled before renewal. Cancellation stops future renewals and does not automatically refund completed billing periods unless required by law or expressly approved by XeanVI in writing. XeanVI may change pricing with notice where required. Failed payments may result in downgrade, pause, or cancellation of access. You are responsible for applicable taxes unless collected at checkout.
Except where required by law or approved in writing by XeanVI, fees are generally non-refundable once a billing period has started. Any refund exception is discretionary and does not waive future enforcement of this policy. This refund policy may be updated from time to time in accordance with applicable law and these Terms.
You must be at least 18 years old and legally able to enter this agreement. You agree to provide accurate information, maintain account security, and not share credentials. You may not reverse engineer, scrape, attack, bypass limits, abuse automation, misuse APIs, or use the Service for unlawful activity. You are responsible for compliance with applicable laws, broker rules, exchange requirements, tax obligations, and recordkeeping duties.
AI and market-data content may be delayed, incomplete, inaccurate, or unavailable. XeanVI does not guarantee data accuracy, completeness, timeliness, profitability, execution quality, or uninterrupted availability. You should independently verify important information before trading.
The Service is provided on an “as available” basis and may be interrupted by maintenance, broker/API outages, cloud failures, websocket disruptions, data provider failures, or security events. XeanVI may modify, suspend, or discontinue features at any time.
XeanVI and its licensors own all rights in the platform, including software, code, dashboards, design, branding, workflows, and related content. Subject to these Terms, you receive a limited, revocable, non-transferable right to use the Service while compliant and subscribed.
You retain ownership of your submitted playbooks, rules, settings, and journal content. You grant XeanVI a limited license to process this data to operate, secure, and improve the Service. XeanVI may use aggregated or de-identified usage data for analytics, safety monitoring, and product improvement.
Prohibited conduct includes unlawful trading, manipulation, fraud, credential misuse, unauthorized API access, and attempts to bypass safeguards. XeanVI may suspend or restrict accounts for suspected abuse, chargebacks, broker issues, nonpayment, legal risk, or security concerns.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF PROFITABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, DATA ACCURACY, OR UNINTERRUPTED ERROR-FREE OPERATION.
To the maximum extent permitted by law, XeanVI is not liable for trading losses, lost profits, market losses, broker failures, third-party failures, data loss, outages, or indirect, incidental, special, consequential, or punitive damages. Where liability cannot be disclaimed, XeanVI’s total liability is limited to the greater of (a) amounts you paid XeanVI in the 3 months before the event giving rise to the claim or (b) $100 USD.
You agree to defend, indemnify, and hold harmless XeanVI and its affiliates from claims, liabilities, damages, and expenses arising from your trades, misuse of the Service, violation of law or broker terms, account compromise caused by your acts or omissions, or breach of these Terms.
You may stop using the Service at any time and cancel subscription renewals. XeanVI may suspend or terminate access for violations, nonpayment, security/compliance concerns, or discontinued offerings.
These Terms are governed by Florida law, without regard to conflict-of-law rules. Unless otherwise required by law, disputes will be brought in state or federal courts located in Florida.
XeanVI may update these Terms from time to time. Updated versions will post a revised “Last Updated” date. Continued use after changes become effective constitutes acceptance.
